TERMS AND CONDITIONS OF PARTICIPATION
We are excited that you’re here! Before you can join, however, we ask that you review the following terms and conditions of participation which apply to participation in the Competition of Garmin Würzburg GmbH (“Garmin”) between the participants and Garmin. Garmin will use a fulfillment Partner called Fitrockr / Digital Rebels GmbH (“Fitrockr”) to assist in the Competition.
Eligibility and possibility to win
Eligible potential participants are all participants of the insureNXT Congress on the 28th of May 2024 (“the Event”) who must be over 18 years of age (“Participants”). Garmin reserves the right to check this by means of suitable proof.
Participants must be in good health to participate. Garmin recommends that you undergo a medical examination before participating, if necessary, and follow any medical advice because of such examination, and only participate if you are in good physical health. Participants declare that they are fit to participate and that there is nothing that puts them at risk of injury, illness or death during participation. Participants agree to be treated in the event of an emergency or other incident where, in the reasonable judgment of persons on site, they require medical attention. Participation is only possible after the complete and truthful provision of all information required for the execution of the Competition and acceptance of these Terms and. By participating in the Competition, the Participant warrants that all the information provided is complete and correct. Garmin has the right to exclude Participants from the Competition if a Participant has provided false, incomplete, or misleading information and/or otherwise commits or attempts to commit fraud and/or does not act in accordance with these Terms and Conditions of participation. In the event of exclusion, the participant has no chance of winning a prize.
Entry Period and Participation in the competition
The Competition starts on 28th of May 2024 (0:00hrs-24:00hrs UK time). Participation is only possible during this period. Participation in the Competition takes place by provision of name and e-mail address and connection of your Garmin Connect or GoogleFit account with the digital application of Fitrockr to be able to synchronize the captured steps with Fitrockr. The goal is to achieve the highest possible step step count overall within this period of time. Participants who have successfully completed the activity and synchronized their wearable with Fitrockr by noon UK time on the 29th of May will be entered into the draw. The two Participants which have successfully completed the activity while covering the highest step count will be the winning Participants. Each Participant may only participate once in the prize draw. Garmin will automatically disqualify the following: all incomplete entries; any entry received outside the Entry Period; any entry that violates any applicable law and any entry that violates the Terms & Conditions.
Drawing of the Winner and Prize; Announcement and Delivery of the Prize
The winners will be selected by Garmin from the valid entries based on the most steps recorded during the competition time. All decisions by Garmin are final. The prize will be awarded to each of the two winning participants who have achieved the highest step count that has been recorded through Garmin Connect or GoogleFit account and synced with Fitrockr. Garmin will award the winners each one Garmin Venu 3 / 3s. Garmin reserves the right to change the Prizes on its own discretion. Prizes are non-refundable and must be accepted as awarded. A cash payment in the amount of the value of the product is not possible. Garmin reserves the right to substitute a prize with another prize of equal or greater value if that prize is unavailable for any reason determined by Garmin in its sole discretion. The winner is responsible for all associated taxes upon receipt of the prize if applicable. Garmin will attempt to notify the winners immediately after the draw. The winners will be contacted via e-mail to facilitate the shipment of the prizes. If a winner cannot be contacted or does not respond within 10 business days, the prize will be forfeited. In this case Garmin will draw a winner at random from the pool of remaining valid entries.
Photo and Video Capture of Competition Participation
The Competition may be photographed, videotaped, or otherwise recorded by Garmin or third parties and Participants agree that Garmin may use their name and likeness in such recordings and other media for any purpose (e.g., internal training or marketing materials) without any additional consideration to me or to any third party unless Participants declare in writing before the participation that they do not want to be included in any captured media.
Indemnification
Participants declare they are familiar with the proper use of the equipment and agree to operate it with due care and assume all risks and hazards of the activity at their own risk, including but not limited to slips and falls; failure to conduct themselves safely and within their own abilities and to remain in designated areas; and/or negligence of other persons; Participants assume full responsibility for any damage or injury they may cause to the equipment, themselves or to others and their equipment and property as a result of their participation in the activity.
DECLARATION OF INDEMNIFICATION
As a Participant I declare for myself and on behalf of my heirs, estate, insurers, successors, and assigns, waive, release, discharge, indemnify, and hold harmless Garmin, its parent company and affiliated companies, officers, directors, shareholders, employees, agents, and representatives, the tour guides, and the successors, assigns, and insurers of such entities, (collectively, the “Released Parties”) from and against any and all claims or causes of action I may have for damages for personal or bodily injury, disability, death, loss or damage to person or property, or any other types of damages arising from or relating to my participation in or attendance at the Competition, whether arising from the negligence of any or all of the Released Parties or otherwise, whether or not negligence has been proven, to the fullest extent permitted by law. This release and indemnity shall survive my participation in the Competition.
Miscellaneous
Garmin reserves the right to cancel, suspend and/or modify the Competition in the event of suspected fraud, a technical problem affecting the administration, security, or proper conduct of the Competition in its sole discretion. In such an event, Garmin reserves the right to award any prize at random among valid entries received up to the time of the impairment. Garmin reserves the right, in its sole discretion, to disqualify any individual who acts in violation of these Terms & Conditions. There is no legal entitlement to the prize. Garmin accepts no responsibility for lost entries or technical malfunctions that may occur during the entry process. Internet access and usage fees charged to Participants for the use of online services may apply depending on the chosen provider and settings at the time of Participation. This agreement is the only and complete agreement between me and Garmin relating to the Competition participation. By agreeing to these event terms and conditions or taking part in the Competition, I for myself, my personal representatives, assigns, and heirs acknowledge that I have read this legal document in its entirety, fully understand and agree with its contents, and fully accept all terms, conditions and provisions herein. I agree to this Release of Liability and Assumption of Risk Agreement freely and voluntarily, without any inducement or coercion.
If you do not want to have a connection between Fitrockr and your Garmin Connect Account after the Participation, please ensure to disconnect Fitrockr in your Garmin Connect account.
PRIVACY INFORMATION
Data protection information. The following data protection information applies to the Participants regarding the use of their personal data during the execution of the Price Draw.
Controller responsible for the processing of data on behalf of Garmin: Garmin Würzburg GmbH, Beethovenstraße 1a, b, 97080 Würzburg
Scope and purpose of data processing by Garmin. With the Participation and Notification of the winner, we will collect the following data from you: First name and last name and e-mail address. We use personal data exclusively in accordance with the relevant data protection regulations. We process the personal data of Participants to carry out the Prize Draw including to determine whether they are entitled to participate and, if necessary, to determine and notify the winner. If we do not collect the above-mentioned data, it may not be possible to participate in the Prize Draw or to contact the Participants regarding notification of a winner. When collecting, processing, and using Participants’ personal data, Garmin will ensure that all personal data is processed lawfully, fairly and in a transparent manner and in a way that is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed. The data will be processed solely for the purposes stated above. The legal basis for the processing of personal data in the context of the Price Draw is the implementation of pre-contractual measures and the fulfillment of contractual obligations regarding the Price Draw in accordance with its Terms and Conditions.
Data Retention. All personal data will be kept for no longer than necessary for the purposes for which it is processed and will be deleted in accordance with the statutory provisions of applicable laws. Any personal data of the Participants processed by Garmin as part of the Price Draw will generally be deleted within 30 days after the Price Draw has commenced.
Data Protection Measures and Data Subject Rights. Garmin takes appropriate security, contractual, organizational, and technical measures to ensure compliance with the applicable data protection regulations to protect the personal data of Participants. Data subjects are entitled to their statutory rights as stated in applicable laws.
